Trish has attracted media attention from many news outlets including Channel 9 News, Channel 7 News, The Sunday Mail, Smart Property Magazine, Your Investment Property Magazine, Real Estate Business, Quest News and QLD Master Builders magazine primarily because of her petition that is currently in Qld Parliament seeking consumer protection rights for home buyers.
Due to her background in property law and her 14 years of experience running BuildingPro, she has identified that no consumer protection rights exist for buyers who buy defective and unsafe properties in Queensland and all other Australian states except the ACT. This realisation prompted her to commence a national online petition and a Queensland Parliament petition that has been sponsored by the Hon Kate Jones MP.
The QLD Attorney-General’s department has confirmed that this area of law needs reform.

PROPERTY owners would have to reveal their home’s dark secrets – including whether they have been murder scenes or drug labs – to potential buyers and tenants under reforms being sought to real estate laws.
Other changes proposed include requiring vendors to disclose any structural defects, and shifting the onus for building and pest-inspection reports to them instead of buyers.

Petition for legislative change to protect buyers from property defects, Quest Newspapers
PAINTINGS placed strategically over cracks, rooms jammed with furniture to prevent entry and even mounds of soiled laundry to hide termite nests.
Trish Mackie-Smith said she had seen it all when it came to dirty tactics used to conceal structural defects during a property sale.
But the Ashgrove resident, who has run building inspection company Building Pro alongside her husband Andrew for 14 years, wants to turn the tables on consumer law to protect buyers from “lemons”.

Andrew Mackie-Smith discusses how to use building or pest reports to negotiate price reductions when purchasing a property.
Finding some minor termite damage is a worry for some property buyers but to a more seasoned investor it can often provide great leverage to negotiate a price reduction from a seller. In this case, the buyer could negotiate for the replacement of termite damaged timber, installation of a termite management system and mitigation of conditions conducive to future termite attack.
This is just one example, I’ve helped lots of clients negotiate price reductions using reports that I have provided after a pest or building inspection.
